Terms and Conditions

These Terms and Conditions govern your access to and use of CogniSport, including the app, optional external CFF hardware workflow, account and leaderboard features, and this website. By using CogniSport, you agree to these Terms. If you do not agree, do not use CogniSport.

1. What CogniSport Is

CogniSport is sports cognitive training and experimental visual timing software. It includes modules for reaction timing, peripheral awareness, multi-object tracking, timing, attention, CFF-style measurement workflows, and optional leaderboards.

2. Not Medical Advice or a Medical Device

CogniSport is not a medical device and does not provide medical advice, diagnosis, treatment, concussion assessment, neurological assessment, vision care, or emergency services. CFF results, reaction metrics, and training scores are informational training outputs only. Do not use CogniSport to diagnose or manage any health condition. Consult a qualified professional for medical, vision, neurological, or health-related questions.

3. Safety and Use at Your Own Risk

Some CogniSport activities use flicker, rapid visual stimuli, audio-visual timing, and sustained attention. Stop immediately if you experience dizziness, headache, eye strain, nausea, disorientation, unusual discomfort, or any symptom that concerns you. Do not use flicker-based features if you have photosensitive epilepsy, seizure risk, migraine aura triggered by flicker, or if a clinician has advised you to avoid flashing lights. Train in a safe environment and use appropriate supervision.

4. Measurement Limitations

CogniSport metrics are affected by device refresh rate, display behavior, brightness, ambient lighting, viewing distance, fatigue, attention, hardware setup, Bluetooth connection quality, and user response strategy. Visual timing and temporal tasks are approximate. External LED CFF workflows depend on the configured hardware and testing protocol. CogniSport does not guarantee improved performance, sport transfer, or any specific score.

5. Accounts, Device-Only Mode, and Leaderboards

You may use supported features in device-only mode or sign in for profile and leaderboard features. You are responsible for keeping account credentials secure and for activity under your account. Usernames, reduced avatar representations, scores, session counts, and leaderboard summaries may be visible to other users where leaderboard features are shown. We may suspend or remove accounts, profiles, or leaderboard entries that appear abusive, fraudulent, unlawful, unsafe, or inconsistent with these Terms.

6. Bluetooth and Profile Photos

Bluetooth and profile-photo features are optional. You can control Bluetooth permission in iPhone Settings. Profile photos are chosen through Apple's system photo picker. Bluetooth-based external CFF hardware should be used only with appropriate electrical safety, LED brightness, and testing controls. Do not modify hardware in a way that could create unsafe light exposure, electrical risk, or unreliable results.

7. App Store and Apple Terms

If you obtain CogniSport through the Apple App Store, your use is also subject to Apple's applicable App Store terms and policies, including the Apple Media Services Terms and the applicable licensed application terms. Apple is not responsible for CogniSport's content, support, claims, or services except as required by applicable law.

9. Intellectual Property

CogniSport, the app, website, visual design, logos, software, text, graphics, and related materials are owned by us or our licensors and are protected by intellectual property laws. Subject to these Terms, you receive a limited, personal, non-transferable, revocable license to use CogniSport for its intended training purposes.

10. User Content and Feedback

You are responsible for notes, profile information, and other content you enter. You grant us the rights reasonably needed to store your optional cloud profile, operate CogniSport, display leaderboard features, and provide support. You keep ownership of your content. If you provide feedback or suggestions, we may use them without obligation to you.

11. Availability

CogniSport does not currently offer paid features, subscriptions, or in-app purchases. We may modify, suspend, or discontinue features, including modules, leaderboards, website pages, hardware workflows, or integrations. If paid features are introduced later, the applicable terms and App Store disclosures will be updated before they are offered.

12. Disclaimers

CogniSport is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

13. Limitation of Liability

To the fullest extent allowed by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, training interruption, injury related to unsafe use, or performance outcomes. Our total liability for any claim related to CogniSport will be limited to the greater of the amount you paid for CogniSport in the three months before the claim or one hundred U.S. dollars.

14. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, costs, and expenses arising from your misuse of CogniSport, violation of these Terms, unsafe hardware setup, user content, or violation of law or third-party rights.

15. Termination

You may stop using CogniSport at any time. We may suspend or terminate access if we believe you violated these Terms or if continued access could create risk, legal exposure, or operational harm. Sections intended to survive termination will continue to apply.

16. Governing Law

Applicable law governs these Terms. Any mandatory consumer protections in your place of residence remain in effect, and nothing in these Terms limits rights that cannot lawfully be waived.

17. Changes to These Terms

We may update these Terms as CogniSport changes. The updated date shows when the Terms last changed. Continued use after a change means you accept the updated Terms.
